Employer? Sure, if it's written into the contract that they're 'liable' for last minute cancellations, and they've signed it. Apprentice? Definitely not, frustrating as it might be.
P216 The apprentice must not be asked to contribute financially to the eligible costs of training, on-programme or end-point assessment.
P216.1 This includes both where the individual has completed the programme successfully or has left the programme early.
Thanks, I was certain we couldn't charge the apprentice, i will double check our paperwork for employer, but then what if the employer tries to recoup this from the apprentice?
It is frustrating when the apprentice cancelled it without even discussing it with the employer in one case.
As long as you've got it in your contract/training plan that the employer is categorically not allowed to recoup funds from the apprentice, and they've signed that, you're personally covered. If they suggest they're not going to abide by those provisions, you should remind them of the rules, and raise it with the ESFA.

EPA cancellation charges

Hi, I'm sure other providers have experienced this situation, but we have had a couple of apprentices lately whereby they have cancelled their EPA the day before and we have incurred cancellation charges. Are we able to pass this cancellation fee onto the apprentice or employer if the reason for cancellation is not reasonable? One reason has been because the employer is giving them a contract regardless of apprenticeship outcome.
