Yes, you are essentially free to engage a subcontractor of your choosing to deliver the functional skills, providing you've got a justified reason for doing so, the employer is okay with it, you've got a contract, and you've generally otherwise complied with all the provisions set out within P175-P205, of which there are too many to list here (it's fairly lengthy). The cost of any FS is not included in TNP1 though, as they're funded directly by the ESFA, and not via the levy funds
P108.4.1 English and maths qualifications; these are funded separately and must not be included in the TNP1 price.
Speaking from experience this arrangement would be a perfect example of meeting the funding rules as this would not be classed as token delivery as you are basically delivering the whole programme minus FS, and not all apprentices will require FS.
What auditors wouldn’t want to see is the opposite arrangement where you only delivered FS and the subcontractor delivered the whole standard.
Apps subbing rules are getting very tricky, we are personally stepping away from subcontracting apps funding.

We are an apprenticeship training provider that doesn't deliver Level 2 English and Maths and we need to subcontract a provider to deliver this part of an apprenticeship. I have had a look at the documentation (and previous FE Connect threads) to see how this works but am still unclear.
Are we free to identify a subcontractor and agree a cost? Is the cost included in the TNP1 total?
