Effectively any 16-19 year old who is in the country legally is fundable on a Study Programme, it's just a question of which of the many exceptions they fit into! Para 40 of the guidance is where you want to look, I suspect your learner will be 40 d or e:
d. those who are dependants of adults residing legally in the UK who have been
given immigration rights as workers to reside in the UK
e. those who are dependants of foreign students where the accompanying
parent or legal guardian has a student visa
depending on whether the person they're a dependant of is a worker or a student. All of the para 40 exceptions remove the need for 3 years residency. Similarly, the expiration date of the visa isn't *super* important because they won't be able to renew until 3-6 months before it ends, but would have the discussion about if they're intending to stay for longer if, for example, you're putting them on a two year course that starts in September!

Anyone know if a Residence Permit valid until 31/12/24 allows the holder to access ESFA funding for a study programme ? Holder is originally from indonesia and has been in UK since 30/1/23 Type of permit is "dependant, leave to enter" also states "Restricted work, no work as a sportsperson"
any help much appreciated
