Hello, the main BIL section of the funding rules (pages 80-83) suggests that BILs are an option due to active learning (or lack of), employer changes, or if it is an apprentice's decision to take a break for other reasons. The BIL flowchart also starts with the question about if it is an 'apprentice's decision'. 

However, P301 (relating to summary of actions to take where a BIL is required), states that the employer must notify the provider if the learner will be absent for a period of time. 

Therefore, if the employer has provided us with a sick note for the learner, could we place them on a BIL now without having evidence on file from the learner covering the BIL being their decision and their intent to return to learning. They attended learning very recently so haven't yet hit the point where we could BIL for active learning.

Yes, you know they're not going to be around, so get them on a BIL.

Sickness has always been a funny one for that, as it wouldn't necessarily be appropriate to get confirmation direct from the learner depending on why they're off, but as (I assume) they'll definitely pass four weeks without learning, then it's not really a problem (and if they do come back within four weeks, you can just put them back to continuing).

Silly question time...Can a learner be put on a BIL before they reach the Qualifying period? I fully expected a no from the Rules but can't find anything?

Depending on when they’re planning on returning a withdrawal might be more appropriate, but there’s no technical reason they couldn’t go on a break. You obviously wouldn’t have received any funding, and the qualifying period criteria would be re-applied once they returned.. but if they completed an episode of learning and now need a break, then that’s the score.

Thanks Ben...was really surprised not to find anything in the rules saying that they had to be seen as a funded start by the ESFA before the BIL occurred but as you say...no monies as a non-qualifier v no monies as on a BIL is all the same...no monies!
