ILR Validation Warning - OTJActHours_03

Hi all, 

In the new version 6 (released 14th March 2023) of the ILR Validation Rules, there is a new Rule under Learning Deliver Rules called 'OTJActHours_03' which is asking for the Actual OTJ Hours of a Withdrawal (which I am fine with and how to do). 

My questions are as follows:

  • What would make this turn into an Error?
  • What impact does this have on the ILR data submitted? (EG; will it impact clawbacks, and if yes, how?)

Warnings, in general, don't turn into Errors unless they're obviously time-bound (eg the ULN ones) and, even then, there would be a separate Error already in the Rules. Which isn't to say that a new Error might be added later in the year/next year...

As a Warning, it has no impact on funds.

This requirement was amended for 222/23 with the following:

This field collects the total Actual off-the-job training hours (as defined in the funding rules) that is delivered to the individual apprentice over the practical period of the apprenticeship (learning start date to learning actual end date). This should be entered at the end of the practical period or where the apprentice leaves the apprenticeship early as a non-completer.

As it is a requirement to now record this in the event of a withdrawal it is assumed it has initially been set as a warning to give time for Providers to correct their data but you should expect it to be changed to an error prior to the year end.

As the validation is only required for withdrawals in the current year for starts in 22/23 then it could if the data is missing or reflects that no or little OTJ training has been recorded result in the ESFA responding with enquiry as to why BIL have not been used to suspend funding and clawback of funds where it is applicable.

The validation is different to the revised funding rule P49 in that the funding rules requirement includes current learners on programme as of 31 July 2022, but the validation only applies to new starts in 22/23 so I am not sure the validation rule is correct.

P49 If planned off-the-job training hours have been submitted in the ILR for the apprentice, actual off-the-job training hours must also be submitted in the ILR, at the end of the practical period or where the apprentice leaves the apprenticeship early as a non-completer; this includes current learners on programme as of 31 July 2022.
