Your best bet is to complete an exit review/interview where (amongst other things) the employer confirms the apprentice was in employment at the time of their EPA. Collecting the promise that they'll be employed at a gateway review would likely not be sufficient.
Alternatively, you could look to get confirmation from the employer via email, but I'd suggest that would be by exception.
The employer declaration in the training plan does not meet the requirements for P351.1 so you will need a further declaration from the employer at the specified date, this is your responsibility you cannot pass this responsibility to the EPAO although they may need confirmation of this and may provide documentation for you to do so.

Hi everyone,
We have had a recent audit where they have questioned the below funding rule and asked us to provide additional evidence that the learner is in employment until the EPA is complete.
P351 The evidence pack must include records and evidence of completion of the end-point assessment for audit purposes. This must be available within three months of you reporting it in the ILR. Evidence of completion would include:
P351.1 signed statement by employer and provider that the apprentice is still employed until the end-point assessment is completed;
We do include a declaration from the employer that the learner will be employed until EPA in the training plan but we have been asked to provide additional evidence at the end of programme as well. The majority of the gateway declarations provided by the EPAOs do not include this statement, so would we need to provide an additional declaration at the point of gateway to cover this? Not sure why some of them have this and others don't?
