1. Them not being here three years yet is the problem. Won't be fundable until they have been. I think "This must be in line with the conditions listed in the decision (or grant) notice they received from UK Visas and Immigration" means if they've got something that says they *can't* study then they'd continue to not be fundable, but if they haven't got that they're fine (love to prove a negative...).
2. Going to depend on their mother and father's citizenship. If they're UK then, no, the learner will need three years (because they're only P371). If they're EU then Right To Family Life kicks in and they'll be immediately fundable given how long parents have been here (P372).
This, of course, is assuming the learner is over 18 (!!!) if they're 16-18 then P391 kicks in and it's likely P391.1 will cover them (and none of the categories in P391 require three years)...

Hi all, I have a 2 status queries, Can they do an apprenticeship, any help appreciated.
The first - The immigration status is Tier 2 Dependant, it states As a dependant, they can study. This must be in line with the conditions listed in the decision (or grant) notice they received from UK Visas and Immigration - They have no such document, they have also not been in the UK 3 years. spouse is on a skilled visa since 2019.
The second - Status - Pre-settled status, Limited leave to remain From the Philippines, This leave is issued in accordance with the EU exit separation agreements: for EU citizens, and the family members of EU citizens, - has been here for a year now and now he has a 5 year pre-settlement status, and is the dependants of his mothers husband. Mother has been here 10 years, step father longer both now UK citizens
