Restart course with a new provider

I just wanted to double check any implications with transferring an apprentice from another college to us, but starting her from scratch. The learner is on a 3 year program and completed the first year with another training provider but is not getting on with their delivery model so both her and the employer wish her to change to us. It's a course with set exams through the course and she hasn't passed many of her first year exams and has been on a break in learning for 6 months (so 11 months on prog, followed by 6 months BIL). We have said we recommend that she stays with her current provider, but she is adamant she wants to leave. 

We use a different awarding body (there is an embedded Diploma) and from her initial assessment there is limited RPL and no APL. We can't claim full funding as the previous provider has claimed 1 years worth funding. The employer has offered to pay the top-up from the funding left to the full funding cap, as she agrees the course should be started again and this is also what the learner wishes. Is there any reason we can't do this? As long as the actual funding claimed by us the previous provider is not over the funding cap, but then topped up with cash?

Sounds like a good solution to a bad situation, particularly the employer paying for the first year again!

You can only claim the balance of funding remaining under the CAP for the Standard.

Martin West, Thanks, I understand that we can only claim funding to cap, but is there any reason the employer can't top up? So for example if the funding cap was £15 and the previous employer had used £5k, then could we claim £10k  TNP under the funding and then the employer pay £5k cash ?

An employer can fund any additional training costs over the CAP buy this is not reported in the ILR or on DAS as this is limited to the balance of ESFA funding due that is under the CAP.
