Functional Skills for funding rules 23/24

The team have been looking over the funding rules for 23/24 and have a query we aren't too sure how to interpret if anyone has had a chance to look at them already.

Section 35 around Maths and English requirements when looking at the published list of acceptable equivalents it says English and Maths qualifications at higher levels 'Where the apprentice has a qualification at level 4 or above (including degrees) this is acceptable if the qualification is predominantly in the subject of English Language or English Literature and/or Mathematics.'

Does this mean a learner would not need to do for example Maths functional skills if they have a higher level in English Language only and no Maths Qualification? or does this just mean that they would not need to do functional skills if they have a higher level in both. 

Also with the wording saying English Language or English Literature can the learner have one or the other and not be required to do functional skills English? 

Any information would be hugely appreciated and thanks in advance!

No, it means they're exempt from having to do the Functional Skill that their Level 4 qualification (or above) is predominantly in e.g., if they had a degree that was at least 50% focused on the ongoing development of reading, writing, speaking, and listening skills, the learner would not be required to do the English Level 2 Functional Skill

Also with the wording saying English Language or English Literature can the learner have one or the other and not be required to do functional skills English?

Yes, either Language or Literature are acceptable, though there are additional requirements if it's a second language.
