We are delivering apprenticeship to an employer who is also able to deliver Functional Skills If an apprentice chooses to undertake their Functional Skills with their employer would this be classed as sub-contracting or is it OK if the employer doesn't draw down funding?

So, the FS will have to be on *your* ILR and *not* the employer's. The Employer MUST NOT generate funding directly for them.
In terms of "is it a subcontract?" the main defining factor is you paying the employer to deliver. If you do not pay them, it is not subcontracting.
