Returning Apprentice Levy funding using code 99

If an apprentice was incorrectly assessed as eligible for levy funding and the funding model in the ILR is changed from ‘36 – Apprenticeships’ to ’99 Non-funded (No ESFA funding for this learning aim)’:

  1. Does code ‘99’ in the ILR trigger a clawback of all the levy funding claimed? (Which is what we want to happen).
  2. Will the individual be considered a withdrawal and therefore appear as a ‘Leaver’ in our reporting?
  3. What changes does the employer need to make in their DAS account – do they need to enter the start date as the end date to close the apprentices account?
  4. How will the learners record in the LRS be updated?

1 No FM 99 does not trigger any clawback.

2 It could depending on the withdraw date.

3 The employer should put a stop as per the start date.

4 Not sure

This may be difficult to amend if the start was in a previous year but you should withdraw from FM 36 as per the start date and then create a new unfunded record for the Apprenticeship FM 99 but you will not need any financial information or ACT recorded in the unfunded record.
