I mean, the thing is, they've no way of checking because fees don't go in the ILR, so, in effect, we can charge "what we want". Note the *should* in that last line is not a *must* and, as you say, even that wishy-washy statement has now gone. They basically don't care.
I think it's mainly dropped out of the discourse because so few learners aren't fully funded these days...

Does anyone know what the current ruling is on charging a fee for an AEB co-funded aim? The paragraph that always used to be in the AEB guidance was removed from 21/22 onwards but I'm sure we can't just charge what we want? Thank you.
67. When charging a fee to co-funded learners, the sum of the government contribution and the learner’s fee must not exceed the fully funded weighted rate for the learning aim, and the learner should not have to pay more than 50% of the unweighted rate.
