Apprenticeship Eligibility

I had a quick look at the funding rules for 22/23 and my interpretation is the learner would need to have the right to work in England as well as an Eligible Residency Status. 

It would be worth having a look through the funding rules doc at Annex A: Eligibility Criteria on page 136 to 145 to see if she fits into any of them categories. Microsoft Word - 2223 Provider Rules_Version 2_Final_Updated030423 (publishing.service.gov.uk)

Ooh, if she was still under 18 then the *special* categories in P391 (22/23 Rules) kick in (she'd be 391.1 from what you're saying here). 16-18 categories *do not* require three years residency.

If she's already 19, once she gets her own visa, then it's going to depend how long she has been here. If it's more than three years as a dependant then she's grand, otherwise she'll not be eligible until she's been here three years.

We have further information with regards to the above potential apprentice.  She has a right to work visa for another 3 years as long as her mum is still being sponsored by the company she works for, is she eligible for Apprenticeship funding or do we need to have 3 year residency?

Is she 19 yet? If so, she'll need three years on her own, if she's still 18, as I mention above, she won't need the three years...

I thought that would be the case, she she will be 19 when she starts her Apprenticeship.  Thanks Steve.

The apprentice will not be 19 until 31st August, her mum is here on a sponsorship with her company for 3 years and will then apply for her citizenship, if we sign her up on her Apprenticeship before she is 19 would she then be eligible based on her mum's situation?

Yes because the rules that apply are based on age at start (looked it up before I made my last comment ;))

19.1. We will use the age of the apprentice on the day they start their 
apprenticeship for all age-based eligibility criteria for that apprenticeship

Thank you, we are just now finding out from her mother if she fits into one of the categories under the 16-18 eligibility rules.
