Break in Learning

A learner has been on a BiL for several months due to sickness.  He has contacted us stating he wishes to return but has recently moved employer.

Do we need to withdraw the learner back to BiL date and restart, or can we return him to learning with the new employer?

Opinions vary, but I got the below response from the ESFA when I explicitly asked them what should happen if a learner changed employers whilst on a break:

When a learner is on a break in a break in learning and changes employer then the aim is withdrawn. This is because the agreed break is with the employer they have now left.

The learner would be recorded as a restart without an agreed in learning when they return to learning with new employer, there would also need to be a change of employer guidance recorded from restart.

My thought as well but had to ask.

Just hope the learner completes otherwise we will be recording him withdrawing for a second time
