So *living* in Scotland is fine as long as they personally work more than 50% in England (which it sounds like this person does not).
If they don't work more than 50% in England then you've got two choices, depending on what the employer wants. Because they are an in-year start, you can just delete them from your ILR, which will have exactly the same effect as withdrawing to start, because they were never eligible. If the employer wants them to continue (and maybe pay you directly for the learner), then they can continue to be returned in the ILR as Funding Model 99, which is good because they'll need to be in the ILR to get their EPA certificate at the end.

Eligibility Query - Learner in Scotland

Hi all,
When we first became a training provider, we have accidentally put a learner onto our apprenticeship when they live in Scotland (they have now been on the apprenticeship for 5 months). In addition, their office/store is in Scotland, but the company is multi-national and also has offices/stores in England.
Is there anything we can do for this learner to continue? If yes, what? If no, do I just withdraw them back to start and let the ESFA claim funding back to the start?
