Hi All, Looking for some guidance regarding our obligations to employer health and safety. We always used to chase ELI certs annually and ask for a H&S policy but in essence this became and administrative exercise offering no value or actual checking that H&S was good with the employer. I’m proposing scrapping this, and instead reinforcing our questions at onboarding to ensure that the apprentice and employer sign to confirm that they have ELI’s/H&S policies in place for legal compliance and that importantly they understand what to do should they need to raise a H&S concern. We already ask several questions during regular reviews to ensure ongoing monitoring. This feels much more worthwhile for all parties as opposed to a tick box exercise of chasing and ELI/H&S annually. ESFA suggest that as per their agreement we just have to be confident employers are doing as they should in line with the law on H&S. so I am seeking guidance from others in what they do in this area.

There is no requirement in the funding rules to do H & S checks, see the guidance from the HSE Young people at work - apprentices - HSE

You're suggestion replaces a figurative tick box exercise with an actual tick box exercise, which I find quite funny.. but it's what a lot of providers do, and you're not wrong to suggest it. As you've rightly pointed out, you don't technically need to collect those docs, and it's the employer's responsibility ultimately.. you just have to satisfy yourself that the relevant policies/procedures are in place, via whatever means you deem is satisfactory

Employers have the primary responsibility for the health and safety of the apprentice and should be managing any significant risks. Training providers should take reasonable steps to satisfy themselves that the employer is doing this.

This doesn’t mean second guessing an employer's risk assessment or risk control measures. You are not required to carry out your own workplace assessment.

Providers can rely on past experience, for example, if the employer is familiar to them and they have a good track record on health and safety. Keep checks in proportion to the environment.

Afternoon all , unsure about this as this something we did do in past roles , do we still ask for an ELI certificate , while the learner is in active learning with us ? I remember this was an area we would monitor , and ask for a new in date ELI whilst the learner was still on program.

so you do what you have always done even it is no longer required.

There is no requirement in the funding rules.
