E&M Sub-Contractor on RoATP

We're looking to replace our English and Maths sub-contractor, does the sub-contractor need to be on the RoATP ?

Funding rules say ... 

P57.6.4 Details of the party responsible for each component’s delivery; this may include the main provider, a sub-contractor or the employer. Where this party is accessing apprenticeship funding for the delivery, they must be on the Register of Apprenticeship Training Providers (unless the exemption at paragraph P179.3 applies).

“Where this party is accessing apprenticeship funding for the delivery”  so the subcontractor needs to be on the RoATP ?  but they actually aren’t accessing the funding, we are, then we pay the subcontractor.  So do they need to be on the RoATP ?

Any advice appreciated (any suggestions for excellent E&M providers also appreciated !)

183. The provider must only use subcontractors that satisfy one of the following three criteria:

  • 183.1. They are on the published Register of Apprenticeship Training Providers (RoATP) and have applied by the main provider or supporting provider application routes;
  • 183.2. They are the apprentice’s employer, or a connected company or charity as defined by HMRC, and are on the published RoATP, having applied through the employer-provider application route; or
  • 183.3. They have applied to the RoATP subcontracting exception process and have been approved to be exempt from the requirement to be on this register and can produce written approval from the department confirming that this exception applies to them, including its duration.

Yes they need to be on RoATP.

P173 Funding for all elements of each apprenticeship will be routed through a single main provider that the employer has chosen. This includes funding for English and maths.

No subcontractor is paid directly by the ESFA it is all routed through the main Provider.
