So the CoF adjustment is worked out on an academic year basis, so it adds up all the non-compliant learners in your R14, works out what bands they're in, then works out what percentage of funding that is out of the total (base rates only). If that percentage is more than 5%, then you will have a reduction of half of that in your allocation in two years' time (so the CoF adjustment on the 23/24 allocation is based on the 21/22 learners).
Regarding learners over 2years - how do the planned hours work? I found some guidance but it has been withdrawn now.
In the 1st year would you use the total hours for the 2 years?
Study programmes delivered in more than one academic year
Some students will need to have study programmes planned over more than one academic year (1 August to 31 July). The funding band for these students is determined by the number of planned hours assigned to them in each academic year. A student can be funded as full time in one year and part time in the next, or part time in both years. This will depend on the planned hours of the study programme within each academic year. Please refer to the funding bands table below for more information on how each band is calculated.
NO! Only the hours up to 31 July or you'll get double-funded.
SP funding is, in the main for people doing September to July programmes, because it's basically the schools formula with some extra bits in. If you are doing non-standard things, you still have to fit round this pattern.

16 to 19 study programme
When a learner has not met the COF and is on a 2 year programme - will they be included in the COF adjustment calculation for both years?
