Learners paying for exam re-sits

Hi,

We deliver an apprenticeship that includes a qualification.  If the learner fails an exam, we charge the employer for the re-sit.

We have had a couple of employers argue with us over the last few weeks and quote the following:

P216 The apprentice must not be asked to contribute financially to the eligible costs of training, on-programme or end-point assessment.  

they have stressed the words 'eligible costs' and are stating exam re-sits are not eligible costs and will be charging the learner for any re-sits.

Has anyone else had this?

That para is about the individual apprentice NOT the employer. Effectively it's down to your contract with them as to who pays for what (they can't make the apprentice pay though!!!). I understand a bunch of providers offer a free resit, but that's out of the goodness of their heart as far as I can tell.
