We're a distance learning provider and all learners apply online so in some cases, they declare on the application they are receipt of low wage but don't always attach the evidence. Most do send it in for the month before but in some cases we might have a learner who provides the payslip for the month after they enrolled - we would then work it back to the tax month and gross pay YTD to establish they were eligible at the start of the course. As the rules state "within 3 months" we've never had any issue with our audits on direct or sub-contract provision before now.

AEB Low Wage Evidence within 3 months

Hi, the AEB funding rules state that evidence seen must be "within 3 months of the learner’s learning start date"
We have been working to this guidance for the last 5 years accepting evidence within 3 months either side of the learning start date but have had a handful of providers recently state that they interpret this as the evidence needs to be 3 months from the learning start date.
Has anyone else been through an ESFA audit and had this clarified? (We have been through an ESFA audit within the last 12 months and this wasn't highlighted as an area of concern to us)
