New Funding Rules Break in Learning

Hoping someone could advise please?

The new Apprenticeship funding rules 23/24 state that if a learner does not attend their planned session then a break in learning must be applied.

If a learner fails to attend their arranged appointment on 30th June and if still absent from work on 30th July - Tutor meets with the learner on 10th August, would we need to apply a break in learning?

 

Just quite confused about this on as it could be interpreted a few different ways.

The principle rule is that there needs to be at least some planned training every month, or else there's a requirement for a break. In your scenario, if the learner did miss the appointment on 30/06, but there was other planned learning activity that month that was attended/completed, you'd be fine. You'd have to ensure anything missed was rescheduled, but the rule doesn't state that all planned activity needs to happen, only that there is a plan for it, and at least some of it happens. 

P75.5 would seemingly cover your July gap, on the proviso (again) that there was a plan for training that month (that just didn't happen for 'reasons'), and that there was learning planned in August that at least partially happened.

 As Ben has said it's all about if the Apprentice has undertaken any planned OTJ training or maths and English during the period in question, if not then a BIL is required.

Meeting’s and reviews are excluded from OTJ training hours, so these activities do not contribute to training activities during any period.

New for 1 August 2023

68 Examinations and other testing must not be included as off-the-job training. These do not meet the definition of new learning.

69 Only statutory leave is deducted as part of the off-the-job calculation. The apprentice’s own annual leave entitlement, which may be higher than the statutory leave allowance, must not be used in the calculation.

71 All planned off-the-job training activity (not just shadowing / mentoring) must be agreed in advance of delivery.

74 The provider is ultimately responsible for the delivery of all off-the-job training, even if this training is delivered by another party.

75 Policy change: Some active learning (off-the-job training or English / maths training) must take place in every calendar month of the practical period. A break in learning must be used where there is no plan for active learning to take place within a calendar month. The only exception to this is for those apprentices with a term-time only contract, where we do not require a break in learning for the month of August. When the training documented on the training plan is complete, the practical period is complete.

New for Version 1:

67 We have considered feedback and now included ‘revision’ in the list of what can be included as off-the-job training. The revision must be specifically required for the achievement of the apprenticeship.

75 We have confirmed that the policy change re active learning every calendar month will apply to new starts and to existing learners on programme on 31 July 2023.

75 We have clarified that if planned off-the-job training is unable to take place as scheduled in any calendar month, a retrospective break in learning is not required, as long as there is active learning in the following calendar month. All missed activity must be re-planned and delivered, so that the full content of the training plan can still be delivered.

Somewhat similar:

If an apprentice took seven weeks of annual leave as their manager told them to do so or lose the leave. They spend some of this time completing assessments and preparing for EPA. They documented their learning and reflections in their portfolio (NOT OTJ but just new learning mapped against the standard). And we added this to the "training plan" during a review.   Would they still have to take a BIL for the 7 weeks or could they continue?
