Employer charging apprentice training costs

Hi, 

We have an apprentice who is about to change employer. She has notified us that her previous employer took £300 out of her last wages. The learner signed another contract with her employer to say that she has to pay back the training costs if she leaves within a certain amount of time.  I know with the funding rules the employer signs to say they will not charge the apprentice, however, where do we actually stand with enforcing this? 

We will be contacting the employer and will be advising them that it's against the funding rules and that they have signed to say they won't do this, however, I'm just wondering where we stand when they have another contract with the learner?

Any advise would be most welcome.

We have sadly had this multiple times and they have always paid them back once you state the rules. The apprenticeship contract trumps anything they may have used internally and even when they have consulted lawyers they have always paid up.
