Part time apprentices hours

The funding rules state that being part time shouldn’t be a barrier to completing an apprenticeship, however the below point suggests that we can refuse to take on an apprentice if they are not working enough hours per week to successfully complete their apprenticeship. I am assuming this is subject to interpretation but if we (employer provider) have evidence that current learners on less than 20 hours per week are struggling to achieve this, would this be a valid argument to set a minimum 20 hours per week requirement for future apprentices? I would be grateful for advice or to hear what others are doing regarding this.

I'd be very wary about setting a blanket minimum as it could be argued that it's against this para to do so:

P35.4.1 Working fewer than 30 hours a week (see 
paragraph P36) or being on a zero-hours 
contract (see paragraph P37) must not be a 
barrier to successfully completing an 
apprenticeship. 

Which is different to you assessing an individual's situation and deciding that it's not going to work...
