No employer within 30 days, processing to a break

When I think about this, the answer is obvious, however I aint going to assume, so we have an apprentice has had no employer for 30 days, therefore we wish to process him on a break, am I right in thinking that the learner will be the only one that sign the break in leaning document, the flowchart & the funding rules do not really clarify this, the flowchart doesn't cover this scenario & is talking about the employer also agreeing to the BIL but in this case there isn't one! Any help would be appreciated - thanks

You sign the form in these circumstances as the BIL is mandatory.

See the funding rules:

P77.2.1 During the programme, if an apprentice becomes unemployed, self-employed as a sole trader, or becomes a shareholder / director with no separate identifiable person to undertake the role of employer, they will at that point no longer be eligible for funding and you must report them as having withdrawn from the apprenticeship on the ILR. If the apprentice has been made redundant, see paragraph P70 .

That is unless they are in the process of changing employer when the following applies:

P267.2 Where an apprentice changes employer and there is a break in employment of more than 30 days and up to 12 weeks, you must, after 30 days, record the apprentice as on a break in learning (see paragraphs P318 to P320).
