Redundancy - Part-Time Learner Impacted.

Good morning, everyone,

We've unfortunately been made aware that one of our learners has been made redundant this morning. The learner in question held a Part-Time position (16 hours a week, inducted in Feb 2022), and as a result, programme duration and OTJ requirements were altered to align with ESFA guidelines. The learner has completed all areas of training, has surpassed the 12-month minimum duration, and has met the OTJ requirement. We want to support the learner in achieving their qualification: under these circumstances, are we able to process to Gateway/Completion as normal?

It is all down to interpretation of the funding rules, from what you say the learner has completed training and meets the definition for the ‘final day’ see below:

I would confirm with the ESFA that this learner can undertake the EPA to complete their Apprenticeship.

Final day

Defined in legislation as the final day of the practical period. This is the equivalent of the learning end date on the ILR (there must be evidence of learning on this learning end date) and internally if also referred to as the “Gateway” between the practical period and the end-point assessment. The term ‘Final day’ is used as a measure in the redundancy policy to determine if the apprentice will be fully funded to completion.

Redundancy

Apprentices made redundant who, on the day of dismissal, are within six months of the final day of the apprenticeship practical period OR they have completed at least 75% of the apprenticeship practical period.

P276 Apprentices who have their apprenticeship agreement terminated by reason of redundancy who, on the day of dismissal, are within six months of the final day of the practical period OR they have completed at least 75% of the practical period specified in the apprenticeship agreement, may continue their apprenticeship training without being employed under an apprenticeship agreement (see paragraph P32.1.1).
