L3 Apprentice and the E&M Flexibilities Pilot

We have accessed an L3 apprentice as working just about at E3 maths. I was just about to exempt them from the Level 2 and make them Entry 3 instead, following the guidelines in funding rules and E&M flexibilities pilot. With the pilot they do not need to have an EHCP.

But we have discovered a GCSE Maths grade 2 (COVID year). In my mind that makes them have at least Level 1 FS. No idea how they managed it given the assessments and 1-1 support we are giving just to get close to E3.

What are everyone thoughts about being able to enrol them on E3, given the GCSE grade 2? Or would you exempt them entirely from any further maths?

Where the learner meets all the requirements for Exceptions to the regular English and maths minimum requirements, for people with special educational needs, learning difficulties or disabilities then you should note that P44 requires that providers must plan and evidence how the apprentice will access further literacy and numeracy development, including level 1 and level 2 courses, as part of their overall training provision.

In practice they would have to undertake training in L2 FS but would not need to achieve it to complete the Apprenticeship and as they would have the exemption as the L1  (GCSE grade 2) would suffice in place of the entry level 3 requirement.
