The ESFA have clarified in 23/24 funding rules that an apprentice is not eligible if their work visa does not cover the duration of the apprenticeship.  So my questions for clarity are;

Visa expires in 20 months but apprenticeship is 24 months, am I eligible?

Visa expires in 3 months but I have requested an extension.  My apprenticeship will last for 2 years, am I eligible?

1. no, not at the moment

2. yes, because you've applied for the extension so, per P290, you are deemed to have that status until your application is assessed.

And this is one of the reasons why this rule change is so stupid.

Hi,

Just to pick up this conversation again, what if the learner intends to renew?  It seems pretty detrimental  to the learner not to allow them to enrol if they currently hold a valid visa and plan to renew it. 

Reading rule 20.4 it seems that, in terms of visa holders,  only learners who are in the process of visa renewal can be enrolled because the other visa holders wouldn't have the time left required to complete an apprenticeship

Yes, yes it is.

But, given it's not been updated in V2 of the Rules, looks like we're going to have to lump it for the rest of the year...
