For ESFA funded provision 3 years residency is required if the learner holds pre settled or settled status. This can be a combination of living in the UK and EU.
They will be fine as long as they can evidence they have pre settled or settled status.
if this is an apprentice and they have pre settled than that would need to be valid for their apprenticeship duration.
Although, just on this last bit, everyone with pre-settled is about to get an automatic two year extension:

which should cover pretty much any App!

Could i have an opinion on the following statement for non UK Nationals, do they still requires the learner to have been in the UK for 3 years?
277.3. Have permission granted by the UK government to live in the UK and such permission is not for education purposes only; or have obtained pre-settled or settled status under EUSS.
This learner has been in the UK over a year and was in Spain for 8 yrs prior. Originally from India.
