Functional skills exemption for a level 3 apprentice

Hi,
Please can someone confirm if there is any way to exempt an apprentice from having to pass the level 2 Functional skill, if they are on a level 3 apprentice.
Rule 38 says - . For those undertaking a level 3 or higher apprenticeship, it is a requirement that they hold or achieve an approved level 2 in both subjects before they can successfully complete the apprenticeship.
But can the exceptions mentioned in paragraphs 43 - 45 be used for a level 3 apprentice, or just level 2? The learner has a EHCP and has gained Level 1 F/s, but her SEN means we are unable to get her through the f/s level 2 in one subject.. She is ready for EPA, but this is holding her back

See the change documentation for Par. 38:
We have updated the text to clarify that those undertaking a level 3 or higher apprenticeship must achieve a level 2 in both English and maths.
