Residency Permit expires prior to the apprenticeship end date

We have an potential apprentice who has provided us with a Residency Permit. The permit is Ukraine Scheme Leave to Remain, however the expiry date is prior to the planned end date of the apprenticeship. They have lived in the UK for 18 months and do intend to re-apply. Would they be entitled to Apprenticeship Funding

This reminds me we've not yet had V2 of the Funding Rules where, as I understand it, there will be "further clarification" on this...

So, the Ukranian permit means they don't need three years before they can start but CURRENTLY P20.4 says those whose visa expires before the end of the Apprenticeship even when there's nothing the learner can do about it shouldn't be started...

Just looking at V2 now after being on leave last week. In the evidence requirement section there is this statement "Confirmation that the provider is satisfied the learner is eligible for funding and (where necessary) where a learner’s permission to stay has expired they must hold evidence that an application to remain has been made".

Not sure that was in V1? Do you read that to mean we can now accept them providing we can evidence the application has been made to remain?

Actually having tracked down a copy of V1 the same statement is in there so no change at all :-(

Yeah, no, they're the "easy" ones, it's the learners whose visa expires in 18 months but they want to do a two year App where it's a problem because they won't be able to even apply for a year or so who are problematic...

apologies for the gap since the last post but - we have an 18 year old enrolled on a one-year 16-18 study programme.  Residence permit is Ukraine Scheme Leave to Remain. Work permitted.  Expires December 2024.  Is this definitely eligible for ESFA 16-18 funding?
