Pretty sure the ESFA can't tell you not to procure the services of a collection agency.. and if all diplomatic avenues have failed? Don't think they'd really care either way to be honest.
Regarding the payments not having come directly from the employer, they'd only know it came from someone else if they were auditing you.. at which point, and assuming you had retained records of proceedings, you could provide what I would think would be an adequate justification.

Hi all,
Could someone advise me on the following please.
We have an employer who is not payment the 5% Apprenticeship contribution.
In this situation, is it acceptable to refer to a collection agency?
My concern with this is we would not have the evidence that this has been paid directly into the back but via the collection agency.
We are no longer supporting new enrolments with this company but I need to resolve this.
