If an apprentice starts their Apprenticeship on 01/11/2023 but the final signature on the App Agreement is 05/11/2023 does this invalidate the Apprenticeship (for which we would have funding stopped)?
No, at least not according to the webinar the ESFA did where they were asked this exact question. They advised that whilst they advise the signatures should be acquired on/before, from a legal perspective it can be signed later as the start date/s will prescribe when the agreement takes effect.

We always try to get Training Plans and Apprenticeship Agreements signed and dated ahead of the Apprenticeship start date; this is normally not a problem.
Version 2 of the Apprenticeship Funding Rules now allows a 42 day period of flexibility in obtaining signatures on the Training Plan (in certain circumstances).
What are the implications of having the Apprenticeship Agreement signed and dated after the agreed Apprenticeship start date? For example, if an apprentice starts their Apprenticeship on 01/11/2023 but the final signature on the App Agreement is 05/11/2023 does this invalidate the Apprenticeship (for which we would have funding stopped)?
