Indefinite Leave to Remain - 16-18 Study Programme

Created

Hi,

I have a young person whom has been in the country since 2022 and has indefinite leave to remain until Dec 2024.

Are they eligible for 16-18 funding on a study programme?

I am looking through the guidance but it is not clear to me. I always thought it was 3 years but she has the leave to remain?

TIA

Chantelle

Learners with Indefinite Leave to Remain are exempt from the 3 years residency requirement (excluding those with Settled Status which is also Indefinite Leave.)

Are you 100% certain it defiantly says Indefinite as it seems odd why it has an expiry date and for that short duration.

Hi Kelly,

It states, Type of Permit - Settlement

Remarks - Indefinite Leave to Remain

Valid until - Dec 2024

That is definitely ILR then. Perhaps it has a short end date because of the learners age.

The learner is eligible.

Is it the physical BRP that expires then rather than the visa itself (in the same way that our passports expire every ten years)? Heard a few people mention this being a thing, but not seen one in the flesh to properly understand it. I agree that anyone with ILR is just day one fundable though and any future "expiry" wouldn't matter for non-Apps anyway, because it's only the Apps rules that are explicit about it...
