Visa Expiry and Auto Renewals

Created

Hi All,

I know there have been some posts around this already, but we are now getting a few applicants where there is less clarity around their expiry of their visas, making it challenging to understand how we capture this within the rules.

We have an applicant on a pre-settled status and their right to work expires during the scheduled programme delivery. However, their visa auto-renews for an additional two years, unless their opt out. As such, they are guaranteed to have a visa extension which would make their visa then extend beyond the planned end date.

Are they eligible for funding or not? I'm not sure?

Thanks

Chris

I mean, I'd say "yes", but then I would, wouldn't I?

We know these visas will auto-renew next year because we have the announcement from the government saying so:

EU Settlement Scheme enhancements confirmed - GOV.UK (www.gov.uk)

So I think it's fine?

Thanks Steve,

I'm inclined to agree and I feel that we could defend it if challenged.

Much appreciated.
