We are just looking to clarify rules around the requirements of evidence regarding an apprentices contract with their employer. One of my Directors is slightly concerned around whether we need to hold a copy of our apprentices employment contract, but the rules state that;
• Evidence of employment to confirm that the apprentice is employed by that employer or a connected company or charity as defined by HMRC. This can be a relevant extract from a contract of employment or it could be a signed declaration by the employer.
I'm confident that the "signed declaration by the employer" is covered by the Contract for Services, but we just want to ensure that this is the case.

Yes, you are right. There have been various points where ESFA have tried to make us get copies of contracts but not now.
