I have an Apprentice who is on the Site Carpentry pathway of the Carpentry Standard. He want to change to the Joinery pathway - I know we will do a 'change' on the Apprenticeship Service (DAS) - do we need to re-contract with the employed / Apprentice?

To complicate the issue, he wants to leave his employer (due to issues in the workplace). He will then have 30 days to find a new employer before we have to put him on a BiL. If he leaves his employer, I assume we cannot change his pathway (within the 30 day period that he is unemployed), even though he will continue attending and wants to attend the joinery sessions, in anticipation of finding employment as a Joiner?

This would normally be a withdrawal, when the learner has left employment, no further training can be funded unless you know that new employment will commence within 30 days.

Thanks Martin. Am I misinterpreting the Funding Rules? I thought that if they resign from their job, they have 30 days to start with a new employer without funding stopping. Then, if they have not found / started employment after 30 days, we use a BiL to stop the funding while they continue to look for a new employer. If no new employer is found after 12 weeks, the BiL status is changed to a Withdrawal?  

228.3 . In circumstances where an apprentice changes employer and there is a break in employment of more than 30 days and up to 12 weeks, please see paragraph 225.1.

225.1 - Where new employment has not commenced within 30 days, the provider must, after 30 days, record the apprentice as on a  break in learning (see paragraph 228.3). Where the apprentice does not re-start with a new employer after 12 weeks, the main provider must withdraw the apprentice to ensure funds are not paid when the apprentice is not employed.

Yes the 30 day and 12 weeks are not an entitlement to continue to train and clam funding when the learner in no longer employed, they only apply where you know they intend or will commence with a new employer on their funded training plan within the time scales that apply.
