Hi all, can anyone help?
We have a potential learner who is in the UK on a BRP which would last well beyond the duration of the apprenticeship, however this learner has not been in the UK for 3 years, does this rule still apply with BRP?

Their BRP should say what kind of visa they have, then you can compare that to the list of who is "day one" eligible.
I have asked this very question to the ESFA this week. Non-UK (Non EEA) National moved to the UK to join British Spouse. Has Right of Entry on BRP. ESFA stated they had to meet the 3 year residency in their own right if they do not meet any of the other exemption criteria.
Yes but, for example, those with Indefinite Leave to Remain also have BRPs and would be eligible from day one. Yours only has Right of Entry which isn't on the day one list.
