In the rules, under "Employer co-investment:
143. The exemptions below apply to paragraph 142. In the circumstances below (paragraphs 144 to 145), the government will fund all of the apprenticeship training and assessment costs, up to the funding band maximum of the apprenticeship.
145. For new starts from 1 April 2024:
145.1. Employers who do not pay the levy, if at the start of their apprenticeship training the apprentice is aged between 16 and 21 years old (or 15 years of age if the apprentice’s 16th birthday is between the last Friday of June and 31 August)
145.2. Employers who do not pay the levy, if at the start of their apprenticeship training the apprentice is aged between 22 and 24 years old and has either an Education, Health and Care (EHC) plan provided by their local authority and / or has been in the care of their local authority (see paragraph 98.2)
It's just non-levy, small is now not relevant at all. They actually mean non-levy account holders, not "employers who do not pay the levy" right now.
I do have a very longstanding query in with the Apprenticeship Service about non-levy account holders who haven't actually paid the levy in years, as they will fall into insufficient funds, and will have to pay the 5%. No answer yet, but if you get any like that, contact the Apprenticeship Service with the specifics.

Morning all,
I'm looking for some clarification regarding the new funding rules for learners starting after April 1, 2024. Specifically, is the employer still required to pay a contribution for 16-21 year old learners if they have more than 50 employees? The rules don't seem to refer to the number of employees any more for new learners. Am I right in saying that if the learner is 16-21 years old then the employer is not required to pay the contribution regardless of the number of employees the employer has?
