Off the Job Training Hours

We have an apprentice who is completing work towards their apprenticeship beyond the off the job hours of 7 per week as assessed at initial assessment by the provider. Can I ask , should the provider be counting off the job hours that the apprentice is working outside of work ? There is no delivery taking place, it is the apprentice working on assignments above and beyond the off the job hours.

Short answer "no" because OTJ needs to be during working hours/"paid back" with TOIL where this isn't appropriate.
