SUB CONTRACTING

Good afternoon,

I have looked at the sub contracting rules for apprenticeships but can't see the actual way to apply to ESFA to be able to sub contract.  Does anyone know if there is a specific process/form we have to complete if we did want to sub contract?  I know we sign the declaration but we have never considered sub contracting before but we are now considering it.  Can anyone point me in the right direction as to whether we need to apply to the ESFA or just complete the declaration?

There is this page:

but it conspicuously doesn't mention Apprenticeships, presumably on purpose? Which implies you can kind of just do it????

You are required to seek approval for subcontracting for their first time- see below. There is an email address mentioned in the below guidance

Right, but that doesn't mention Apps at all? I mean, I agree that sending something to that email is probably not a bad idea, but I'd go for "we assume we can just sub-contract, let us know if not"?

Considering subcontracting of apps falls part of the subcontracting standard I don't understand why they wouldn't expect providers to seek approval - strange

Yeah, I agree an email should be sent. At least the provider is covering their back.

Sure, but the Standard only kicks in at £100k.

Did you hear back about the Standard by the way? My current provider doesn't sub ESFA work so I'm a little out of the loop...

Yes we were awarded the standard in March/April (I think.) It was a relief once the email came through considering we submitted our report last July.

Steve Hewitt & @kellyknights.  I find it all really confusing!  I had checked all of these guidance before posting here, and that was another reason I got confused.  As you have said, it does not mention apprenticeships, and also when you go to this link below which is in the 3rd sentance on the subcontracting for the first time page: it is clearly says (excluding apprenticeships).https://assets.publishing.service.gov.uk/media/66697afc9d27ae501186db36/24-25_Subcontracting_funding_rules_for_post-16_education_and_training__excluding_apprenticeships_.pdf

I guess we are best just to the follow the rules and get written approval.
