Probably yes. First obvious question is have they been here three years, but then you really need to know the visas they've been on. If they were on a Student visa (rather than a dependant of a Student?), the Apprenticeship Policy team have determined* that time spent here on a Student visa DOES NOT COUNT as Ordinarily Resident.
*Incorrectly, in my opinion, but I've not got the resources to legally challenge it

We have a potential learner on a Graduate Dependent Visa and are a bit confused as to whether they are eligible. They are eligible for work til the end of the apprenticeship. Is it that we need to know the type of visa they held before this one to determine eligibility?
