Apprenticeship Wages for second apprenticeships

We are working with an employer who is looking to take on a learner who has done an apprenticeship before. 

Based on the wording on the national minimum wage rates page am I right in thinking that they can offer the apprentice apprenticeship wage for the first 12 months even though the learner is over 19 and done an apprenticeship before. The first apprenticeship was completed and achieved around 6 months prior to applying for the current one.

Tricky one as it is not clear in the funding rules.  I worked with an employer previously who were adamant that it related to any apprenticeship for the first 12 months and as such, they paid a single parent the NMW for an apprentice even though she had completed one previously.  I personally do not think this is ethical!  This would be for the ESFA directly I think
