T-Level transfer issue

We have a learner who has transferred to us from another provider to continue their T-Level qualifications.
They have already achieved the T Level Occupational Specialism - Electrotechnical engineering with the other provider and the achievement is in their PLR data,
The problem we have is that if we don't include the T Level Occupational Specialism in our own ILR return it triggers an ILR error:
ProgType_19 Error
This programme type cannot be used for this learning aim
Version: 1
Status: active
Details: If there is no record of a T Level Technical qualification (LARS_LearnAimRefType = 1468) in the programme, then the T level programme type must not be returned
(error where there is no record of LearningDelivery.AimType = 5 where LearningDelivery.LearnAimRef = LARS_LearnAimRef and LARS_LearnAimRefType = 1468 and there is a record of LearningDelivery.ProgType = 31)
So we have to include it, but now we have an achievement both in our data and the other provider.
I've asked the ESFA helpdesk about this, but wondered if anyone else has had this situation too?
