So, I definitely wouldn't use a non-reg aim because the learning is regulated...
This *feels* a little bit like A Level Art where there's only one learning aim but several routes through it so you *do* use the same eight digit code to describe two different bits of learning because you've no other choice. That's just done as a given (although you have to explain it laboriously to each auditor that walks through the door), but I think this is the same. You could show an auditor the unit list which comprises sufficient units for the learner to be awarded the Award and show how these differ from the last time they were awarded the Award (!!!).
And, as always, a small number of learners not obviously "progressing" is fine as long as there are Good Educational Reasons, para 87:
87: Institutions must be able to demonstrate educational progression for students recruited onto programmes funded by ESFA and be able to record evidence of good educational reasons for individual students recruited to programmes which do not provide progression. All such students should only make up a small percentage of the total student cohort.
Thank you for your support, and yes perfect sense with the non regulated aim, when it comes to the learner completing and hopefully achieving the award (credits of the same value) again would this be ok to report as achievement again using the unit certificates to confirm the credit values would have generated the Award if not previously achieved?

Thank you for adding to the post, this would be for a Level 2 Award in Progression, the credit values between an award and certificate are too much of a jump, the qualification offers a broad range off opportunities. Unfortunately the qualification does not have an step in-between such as an extended award at this level which would have bridged the gap towards the certificate.

Post 16 - Repeating a learning aim

Please can someone point me in the right direction for clarification on the below regarding post 16 study programmes:
I have been asked if a returning learner would be able to complete the same learning aim they have achieved in the last academic year. This is not to repeat the same units within the qualification but to select a range of relevant units that suit their ongoing progression.
Normally my advice is to ensure that the learner is progressing up within the qualification from the award to certificate, however in this instance the credit jump would be too high to go from the award to certificate. I am clear that we would not re register and get a regenerated certificate for that qualification as it has already been achieved. We would, however, receive unitised certificates showing the new units achieved within the qualification.
Rather than repeating the qualification, would it be more appropriate to assign a non regulated learning aim to the student and assign their milestones for this against the units they would be working on with the the previously achieved qualification. This would be supported by justification of prior learning and rationale as to why we wouldn't side step to another qualification not aligned to the learners goals? I cannot see how I would be able to report achievement for a second time given it has been achieved previously however the qualification offers more opportunities for the learner inline with their abilities and progression goals.
