EmpStat_21 not triggering for FM38

Good afternoon,
We have been contacted by one of the combined authorities that we deliver ASF for to let us know that we have learners with blank employment statuses, when we have checked the status is blank. We would expect this to be picked up in rule violations as it would have been previously, in the rule violation spec for 24/25 there is a new rule for FM38 - EmpStat_21 but it appears not to be triggering. I have raised a call with the agency as there are no known issues that I can see on the known issues doc but other providers may want to check their data.

Just out of interest, is this in both FIS and SLD?
We only use SLD so haven't tried FIS, they've actually been there for a few weeks, come through to the occs list the lot, but didn't have any employment status in the file.
OK, just did a rough and quick test (ie opened XML, found an FM38 learner and completely deleted their EmpStat record) and it's gone through FIS as well without erroring...
The rule mustn't be switched on, I've updated the handful we have today by running a different report to check, not something you expect to be missing though!
