L2 Apprenticeship English and Maths - FSkills L2 ?

Just need the new 24/25 rules for English & Maths confirming by someone if possible.

38.1.1 Policy update:   Basically, for a level 2 Apprenticeship the prior equivalent qualification for E&M has been lowered, meaning a learner on a L2 App with a GSCE 1 for E&M does not have to take FSKills at Level 1.

However …

38.2. Where the apprentice already holds approved level 1 qualifications:

38.2.1 The apprentice must start, continue to study, and take the assessments for a level 2 English and / or maths (Functional Skills level 2 or GCSE 9 - 4). This requirement must be fulfilled before the apprentice takes the end-point assessment. The apprentice should be assessed at level 2 for all three units of the English functional skills and the assessment for maths.

So does this mean, although the learner is now exempt from FSkills L1, they will still need to be registered for L2 FSkills, complete the learning, take the exams, but does not have to pass ?

They haven’t updated the prior equivalent qualification list yet.

In a word, "yes". All it's doing is avoiding people failing the L1.

I understand you can retrospectively apply the exemption rule for apprentices. If they are within 3 months of gateway and are on track for this can this form a waver for sitting the level 2 as they don't have time? I can evidence teaching for the L1 qualifications but they are now exempt as I understand it.
