Covid f/s before gateway flexibility

Hi, We have an auditor stating that we should have claimed full achievement for an apprentice who completed under the covid flexibilities that stated an app could progress to Gateway/ EPA without having their f/s level 1 (level 2 app) . But wouldn't be classed as an achiever unless they then retrospectively passed the f/s needed for Gateway at that level. I have trawled through the covid flexibility info but can't see this particularly flexibility, just the updated ones like not having to attempt level 2 f/s . Can anyone point me in the direction of the official guidance? I have found Awarding body and other articles referencing it, but not the correct ESFA guidance. Just to confirm it's a level 2 app, didn't have level 1 maths, passed EPA but was then unable to achieve the maths L1 . Thanks
