Functional skills exemption

Hi,
I have emailed ESFA and chased up many time since last month but no reply, can anyone please shed some light here as the learner is waiting to get completed.
Can you please let me know if the learner is exempt from English L2.
I have a learner with Pre-master programme (RQF Level 6).
The cert holds academic English skills Achievement details where it shows the learner has scored the following:
Listening 82%
Reading 63%
Writing 68%
Speaking 56%
The apprenticeship standards for English and Maths says
“Where the apprentice has a qualification at level 4 or above (including degrees) and/or SCQF level 7 and above (such as an Advanced Higher),this is acceptable if the qualification is predominantly in the subject of English Language or English Literature and/or Mathematics.
For example, 50% or more of the content and assessment of the qualification should be focussed on the subject of English (language and/or literature) or maths”.
I need to know if the learner is exempt or not from taking the functional skills?
