Evidence Non UK national has been resident in the UK for 3 years

Afternoon all,

we recently had an audit, 2 Non UK nationals were picked as part of this audit.

We ask both our applicants and employers to tick a box to confirm that the applicant apprentice has been resident in the UK for over 3 years, the auditor has informed me that we need to note at the onboarding the 'actual hard evidence' we have seen to prove this statement.  I know the obvious things such as the applicant being employed with their current employer for longer than 3 years etc, Driving licence start date, but can ask what evidence do others seek where the obvious isn't available?  The BRP online system only states the expiry date.

Hi Faye, 

We have been told by our local authority to start using eVisa share codes as all BRPs expired in December 2024 and moved to the new system. 

If you have a learner who hasn't changed from a BRP to eVisa they can do so through here: https://www.gov.uk/view-prove-immigration-status

We then use the share code here: https://www.gov.uk/check-immigration-status

The code expires after 90 days and you will also need the person's date of birth. 

The service will show if they have the right to live in the UK, and any restrictions on their rights or access to benefits and services.

Do you reference anything on the enrolment form?

Hi Chris,

We ask the question on our initial application form, and then on an enrolment form.  We also ask where possible for the employer to confirm this as well.

Always been a funny one for employed learners as the employer should complete all the correct checks for eligibility to work. 

Is the auditor asking for hard copies of their right to work or for it to be referenced better on the enrolment form?

Hi Chris,

the auditor actually asked what evidence we get to prove they have been resident in the UK for 3 years, they didn't say we had to keep this evidence they just said we should be noting what proof we have seen that they have lived here for 3 years?
