Hi,

We have a potential learner who is currently a company director but does not own the company.  I know we can accept him as an apprentice under these circumstances.  We have advised him we would not be able to accept him onto programme if he owned the company.  He has now stated that he might become the owner part way through the apprenticeship.  If this was to happen would we then have to withdraw him or would he be able to complete as he wasn't an owner when he started?

Hi Jean

I think the following rules would come into play for this one. 

22. A provider must not claim funding for individuals who:

22.3. Are a shareholder / director with no separate identifiable line manager to
undertake the role of ‘employer’, as defined by these funding rules;
22.3.1 During the apprenticeship, if an apprentice becomes selfemployed as a sole trader, or becomes a shareholder /
director with no separate identifiable line manager, they will
no longer be eligible for funding and the provider must report
them as having withdrawn.
